Trademark, patent, industrial design and copyright: which protection for which asset

Each form of intellectual property protects something different.

Trademark

Distinctive sign (name, logo) identifying product or service. Registered at INPI. Validity 10 years, renewable.

Patent

Technical invention with new and non-obvious solution. Registered at INPI. Validity: 20 years (invention) or 15 years (utility model).

Industrial design

Ornamental aesthetic form. Registered at INPI. Validity: up to 25 years.

Protection of original work (text, image, software, photo). Automatic, but registration recommended.

Geographic indication

Identification of geographic origin granting quality. Registered at INPI.

How to combine

A product can accumulate multiple protections. Companies that protect only the brand leave other assets vulnerable.
